N.B.: The following cannot be subject to reporting, public disclosure, or complaint:


  • Disputes, claims, or requests related to a personal interest of the person making the report or the person who has filed a complaint with the judicial or accounting authorities, which are exclusively related to their individual employment or public service relationships, or pertaining to their employment or public service relations with their hierarchical superiors;


  • Reports of violations already regulated by mandatory acts of the European Union or national laws indicated in Part II of the annex to the decree, or by national laws that implement the European Union acts indicated in Part II of the annex to Directive (EU) 2019/1937, even if not listed in Part II of the annex to Legislative Decree 24/2023;


  • Reports of violations related to national security, as well as public procurement concerning defense or national security matters, unless such matters fall within the relevant EU derived law.

A) VIOLATION OF NATIONAL LEGISLATIVE PROVISIONS:
Administrative offense;
Accounting offense;
Civil offense;
Criminal offense;
Serious unlawful conduct pursuant to Legislative Decree 231/2001 (e.g., undue perception, fraud against the State/EU, computer fraud/supplies) or violations of the organizational and management models required by law.
B) VIOLATION OF EUROPEAN LEGISLATIVE PROVISIONS:
Illicit act falling under EU acts on public procurement, financial services/markets, anti-money laundering/anti-terrorism, product/transport safety, environmental protection, radioprotection/nuclear, food safety/animals, public health, consumer/data/privacy protection, network/information system security.
Acts or omissions that harm the financial interests of the Union;
Acts or omissions concerning the internal market (by way of example: violations related to competition and state aid);
Acts or behaviors that undermine the purpose or objective of the provisions of the Union acts.
