MODULO PER EFFETTUARE UNA SEGNALAZIONE AI SENSI DEL D.LGS. 24/2023(C.D. “WHISTLEBLOWING”)



Il presente modulo può essere compilato per effettuare una segnalazione ai sensi del d.lgs. 24/2023,
secondo quanto illustrato all’interno del documento informativo predisposto dall’ente in materia di
whistleblowing e dell’informativa sul trattamento dei dati personali rinvenibili sul sito web dell’ente,
nella pagina/sezione dedicata al whistleblowing, ai quali si rinvia. La segnalazione sarà gestita secondo
le previsioni di legge e di quanto indicato dalle Linee guida ANAC in materia, anche al fine di garantire
il rispetto della normativa in materia di protezione dei dati personali.
Il modulo si compone di quindici punti, articolati su sei pagine. Nell’ultima pagina si chiede al
segnalante di inserire la propria sottoscrizione (a meno che la segnalazione sia anonima).
Al presente modulo deve essere allegata copia del documento di identità del segnalante
(a meno che la segnalazione sia anonima).
N.B.: Con l’invio della segnalazione il segnalante dichiara di aver preso visione della predetta
informativa sul trattamento dei dati personali resa ai sensi degli artt. 13 e 14 del Reg. UE 2016/679,
nonché del documento informativo in materia ivi pubblicato.

Note: The following cannot be subject to reporting, public disclosure, or denunciation:


  • Complaints, claims, or requests related to a personal interest of the person reporting or the person who has filed a complaint with the judicial or auditing authority, which solely concern their individual labor or public employment relations, or related to their labor or public employment relations with their hierarchical superiors;


  • Reports of violations already regulated mandatorily by the acts of the European Union or national laws indicated in Part II of the annex to the decree, or by national laws implementing the European Union acts listed in Part II of the annex to Directive (EU) 2019/1937, even if not specified in Part II of the annex to D.L. 24/2023;


  • Reports of violations in matters of national security, as well as contracts related to defense or national security aspects, unless such aspects fall within the relevant EU derived law.

Civil offense;
Criminal offense;
Serious unlawful conduct under Legislative Decree 231/2001 (e.g., undue perception, fraud against the State/EU, computer fraud/supplies) or violations of the organizational and managerial models required by law.
B) VIOLATION OF EUROPEAN REGULATORY PROVISIONS:
Illicit act falling under EU acts on public procurement, financial services/markets, anti-money laundering/anti-terrorism, product/transport safety, environmental protection, radiation protection/nuclear, food safety/animal protection, public health, consumer/data/privacy protection, network/information system security.
Acts or omissions that harm the financial interests of the Union;
Acts or omissions concerning the internal market (by way of example: violations related to competition and state aid);
Acts or behaviors that undermine the purpose or objective of the provisions laid out in the Union acts.
